Dispute Resolution Against a Certified Professional Builder

The Oklahoma State Home Builders Association encourages its members to seek and resolve business controversies through non-litigation mechanisms. The first recommended step is to encourage members to include a paragraph within the body of their contracts that speaks to third party arbitration process.

The role of the Oklahoma State Home Builders Association shall be limited to recording the complaint and referring it to the proper jurisdiction for arbitration. The state shall have no responsibility to determine the merits of the complaint or to offer any suggested resolution. Each local association shall select its own neutral third-party venue for resolving disputes.

Should the complainant contact the local association to initiate the process, the local association shall immediately notify the State Association that the action has occurred, and the State Association shall make appropriate record in the file of the Certified Professional Builder against whom the complaint has been made. Should the complainant initiate the process through the State Association, the State Association shall record the action in the Certified Professional Builder's file, determine the appropriate jurisdiction, notify that jurisdiction, and direct the complainant accordingly.

Once the dispute has been resolved, the State Association shall be notified and the action recorded in the Certified Professional Builder's file.
